These terms and conditions of use refer to the Bangla Journal website (www.banglajournal.org; hereafter ‘BJ Website’). These terms and conditions apply to all users of the ‘BJ Website (“you”), including individual subscribers to the print edition of the Bangla Journal who wish to access our archived materials.
Each time you use the BJ Website you signify your acceptance of these terms and conditions. If you do not agree, or are not comfortable with any part of this document, your only remedy is not to use the BJ Website.
By visiting the BJ Website whatever route of access, you agree to be bound by the terms and conditions currently prevailing.
The Bangla Journal reserves the right to change these terms and conditions at any time and your visit to this website constitutes acceptance of the current terms and conditions.
The terms and conditions of any subscription agreements which educational and other institutions have entered into with the Bangla Journal apply in addition to these terms and conditions.
You undertake to indemnify the Bangla Journal fully for all losses damages and costs incurred as a result of your breaching these terms and conditions.
The information you supply on subscription to the BJ Website shall be accurate and complete. You will not assist nonsubscribers to gain access to the BJ Website by supplying them with your password. In the event that the Bangla Journal considers that you have breached the requirements governing subscription, that you are in breach of these terms and conditions or that your or your institution’s subscription to the Bangla Journal lapses, your subscription to the BJ Website will be terminated.
Use of the ‘subscriber only’ content on the BJ Website is strictly for the personal use of each individual user who may read the content on the screen, download, store or print single copies for their own personal private non-commercial use only, and is not to be made available to or used by any other person for any purpose.
Each institution which subscribes to the Bangla Journal is entitled to grant access to persons to register on and use the ‘subscriber only’ content on the web site under the terms and conditions of its subscription agreement with the Bangla Journal. These users are ‘institutional users’. Each institutional user of the Bangla Journal may access and search the Bangla Journal archive and view its entire contents, and may also reproduce insubstantial extracts from individual articles or other works in the database to which their institution’s subscription provides access, including in academic assignments and theses, online and/or in print provided all such quotations are duly credited to the author and the Bangla Journal. Institutional users are not permitted to reproduce any entire article or other work, or to make any commercial use of any Bangla Journal material (including sale, licensing or publication) without the Bangla Journal’s prior written permission.
Users may use any one computer to access the BJ Web site ‘subscriber only’ content at any time, so long as that connection does not allow any other computer, networked or otherwise connected, to access ‘subscriber only’ content.
The BJ Website and its contents are protected by copyright and other intellectual property rights. You acknowledge that all intellectual property rights including copyright in the BJ Website and its contents belong to or have been licensed to the Bangla Journal or are otherwise used by the Bangla Journal as permitted by applicable law.
All intellectual property rights in all kind of texts (include poems, stories, articles, reviews and essays) and images originally published in the print edition of the Bangla Journal and subsequently included on the BJ Website belong to or have been licensed to the Bangla Journal. This material is made available to you for personal use only. You may not download, store, disseminate, republish, post, reproduce, translate or adapt such material in whole or in part in any form without the prior written permission of the Bangla Journal. To obtain such permission you need to contact us.
The BJ Website is provided on an ‘as is’ basis and the LRB gives no warranty that the BJ Website will be accessible by any particular browser, operating system or device.
Any e-mail services supplied via the BJ Website are subject to these terms and conditions.
You will not knowingly transmit any virus, malware, Trojan or other harmful matter to the BJ Website. The Bangla Journal gives no warranty that the BJ Website is free from contaminating matter, viruses or other malicious software and to the fullest extent permitted by law disclaims all liability of any kind including liability for any damages, losses or costs resulting from damage to your computer or other property arising from access to the BJ Website, use of it or downloading material from it.
The Bangla Journal does not warrant that the use of the BJ Website will be uninterrupted, and disclaims all liability to the fullest extent permitted by law for any damages, losses or costs incurred as a result of access to the BJ Website being interrupted, modified or discontinued.
Any transaction effected with a third party contacted via the BJ Website is subject to the terms and conditions imposed by the third party involved and the Bangla Journal accepts no responsibility or liability resulting from such transactions.
The Bangla Journal disclaims liability to the fullest extent permitted by law for any damages, losses or costs incurred for unauthorised access or alterations of transmissions or data by third parties as consequence of visit to the BJ Website.
Communication by the Bangla Journal
From time to time the Bangla Journal may contact its users via e-mail, phone or SMS for invitation for participation in discussions and feedback on its contents or issues arising thereof.
These terms and conditions are governed by and will be interpreted in accordance with laws of Canada and Bangladesh and any disputes relating to these terms and conditions will be subject to appropriate jurisdiction.
If these terms and conditions are not accepted in full, use of the BJ Website must be terminated immediately.
